Basic Terms of Service

The terms in this document are subject to change at any time. I attempt to make any changes when my queue is empty, as to not infringe on current work.

I have the right to decline any request at any time based upon my comfort level with the customer and with what is being requested/my ability to deliver what is asked for.

I reserve the right to use the designs or commissions I have drawn/created as portfolio pieces or for personal promotion. I will not reclaim designs once the purchase has been made final, but the art remains mine to use as a way to promote my work.

My work may NOT under ANY circumstances be made into a non fungible token (NFT). If you see my art being distributed as such please contact me and let me know. Anyone found to be using my art as an NFT will be blacklisted.

You may not trace my work, edit my work, reupload my work without credit, claim my work as your own, etc. You may NOT sell any work I produce for you unless commercial rights are discussed beforehand, etc.

Artwork Terms of Service

NOTE: I do not accept commissions with deadlines unless the commission is ordered in advance. Deadlines must be approved by me.

You MUST provide a clean reference when requesting a commission. Clean references range from a non-shaded one-sided fullbody that shows markings to a full detailed reference image. I will NOT work solely off of written descriptions of OCs. The only exception to this rule is roughsheets or moodboard customs

If you do not want art liberty on posing/expression/etc. you MUST let me know before sketching. Writen or art/photo reference are both valid ways to request posing and such.

I will accept requests for changes to the artwork up until a certain point- changes requested post-line approval will be subject to an extra charge. Changes requested post-coloring will either result in an additional extra charge or be denied.

Do NOT claim the artwork you receive as your own.
Do NOT repost any image without permission AND credit.
(character storage sites such as toyhou.se are exempt from this rule)
Do NOT manipulate, edit, trace or copy any of my work.
You may NOT redline, edit, or draw over my art during the approval stages

You may print or reproduce the art for personal use WITH PERMISSION, but you may not sell the art in any form or use it in any way for commercial purposes. (EXAMPLE: You may print the art on a t-shirt for yourself or your friends, but you may not sell the t-shirt)

Please be patient. In regards to turnaround commissions may take anywhere between less than a day to 3 months based upon the commission requested and my workload.

I attempt to complete commissions in order, but if I'm struggling I may move onto another one. Feel free to request updates on how your commission is going. I can provide updates as frequently as requested within reason.

DESIGN Terms of Service

By buying a character design as an adoptable or custom from me you agree that you have read my terms of service and understand that it is a binding contract and that all other terms of service apply.

By buying a design from me be it a custom or an adopt you are now the certified owner of that design and now own full rights to the design and character. You can do as you please with the design so long as you stay within the rules provided here.

Personal AND commercial rights are purchased by default alongside character designs.

This includes: using a design as a mascot, for merch (such as plush, pins, etc), fursuit, etc
Credit for the original design is required as a username plug and/or link the first time you yourself post the design anywhere. (i.e. if you post the art on twitter, please link to my account)

You retain full rights to resell the character but it is heavily preferred that when reselling, you retain the base price as the maximum UNLESS it comes with additional artwork.

I do allow individuals to purchase designs with the sole purpose of making them into commercial items such as pre-made suits, plush adopts, pin adopts, and similar sellable items as long as it is discussed with me first, as I may require an additional fee for that form of commercial use- I am fully open to discussing this though!

Trading and gifting can be done as you please.

You are within your full rights to redesign a custom or character however you deem fit. I would prefer it remain recognizable when compared to the original but it's your design now- do as you please/deem fit!

You may give your characters any name, gender, identity, personality, etc. You may use the character in any way that you want including 18+ or vent-based themes, however, I do NOT condone the use of my designs for any hateful themes.

PAYMENT TERMS OF SERVICE

If payment has been received before a commission has been approved by me, it will be refunded in full. Payment will ONLY be accepted post-acceptance.

Payment must be sent before I begin working. Payments not received within 48 hours of invoicing (unless I have been informed of a delay) will be cancelled.

All payments must be done via paypal invoice to ensure that the proper amount is sent and any non-USD payments are properly converted and paid in full. I do NOT accept Cryptocurrency as a valid form of payment.

REFUND POLICY

Commissions that have not been started are eligible for a full refund.

Commissions in the sketch phase are eligible for partial refund.
If you would rather give up rights to the sketch, I can offer a full refund BUT I will hold the right to use the sketch for another commission/YCH/etc.

Finished commissions or commissions in the coloring phase can NOT be refunded after a buyer approves them during other stages/WIP approval.

Edits can be requested if there is something about the work that needs fixing but past a certain point (typically the lining/coloring phase) work will NOT be refunded if it is not up to standards/not what is wanted by the commissioner. Please be sure to look over sketches closely before approving to make sure everything looks right.

Commissions that take longer than 3 months to complete are eligible for a full refund upon customer request if they deem the wait too long.

In the event of a refund the commissioner will automatically lose rights to the artwork. Commissioners are PROHIBITED from taking unfinished artwork to other artists.
